Everyone over the age of 18 years should have a legal Will, particularly where you have property and possessions to gift after your death and where you have responsibility for providing for others.
What is a Will?
A Will is a legal document which details who’ll receive your property and possessions after you die. Having a valid Will is the best way to determine your assets go where you want them to. This is especially important if your family or others are financially dependent on you.
What makes your Will valid?
Whilst the legal requirements vary slightly from state to state there are certain things the law requires in each state for a Will to be considered valid. These include:
- The Will is in writing;
- The person making the Will has testamentary capacity, which means you must be over 18 years old and understand what you are doing;
- The Will has been signed by you and witnessed by two independent and competent witnesses
